Electrical Safety Certificates

The Electrical Safety Council have recently published a Landlord’s guide to Electrical Safety.

This guide has been designed to help landlords understand their responsibilities for ensuring electrical safety in their rental properties. Landlords have a legal duty to ensure that their rental property and any electrical equipment provided is safe, both before a new tenancy commences and throughout its duration ‘Landlord & Tenant Act 1985.’

It is imperative to understand that every electrical installation deteriorates with use and age. Landlords must ensure that the electrical installation remains in a safe and serviceable condition.

Although it is not mandatory to have electrical equipment checked each year, failing to make sure that equipment, appliances, plugs, sockets and adaptors are safe is a criminal offence. It is recommended that testing is carried out at a minimum of every five years or at the end of each tenancy. Periodic checks by qualified and approved electricians are essential and their inspection will help:

  • Discover if electrical circuits or equipment are overloaded
  • Identify a Faulty fuse box
  • Ensure your electrical system complies with the current electrical regulations
  • Identify potential electrical shock risks and hazards
  • Find any defective electrical work
  • Highlight any lack of earthing or bonding.

Portable Appliance Testing – PAT Testing

The Electrical Equipment (Safety) Regulations 1994 requires that all mains electrical equipment (cookers, washing machines, kettles, etc), new or second-hand, supplied with the accommodation must be safe. Landlords therefore need to regularly maintain the electrical equipment they supply to ensure it is safe.

These professional checks on portable appliances should determine:

  • That there are no cuts or abrasions in the cable covering (sheath)
  • The outer covering of the cable is gripped by the cord grip in the plug top ensuring no coloured cable cores are visible from the outside of the plug
  • There are no signs of overheating or burning, particularly at the plug socket
  • There are no loose parts or screws
  • No part of the appliance is damaged

Landlords should hold certificates for each of their Buy to Let properties in relation to Electrical Safety Inspections and PAT testing. Gas Safety Certificates

It is a legal requirement that any property that houses gas appliances and associated pipework and flues, should comply with The Gas Safety Regulations 1998. In summary this means that:

  • An annual inspection from an approved Gas Safe engineer is required by law.
  • The Gas Safe engineer must produce a Gas Safety Record which should clearly state the date of inspection and if any defects have been identified.
  • This record must be available to the tenant immediately upon request. We would recommend providing a copy at the commencement of the tenancy and following each annual inspection.
